Customer represents and warrants that they will comply with the applicable legal requirements relating to reporting discounts under 42 U.S.C. § 1320a-7b(b)(3)(A) and 42 C.F.R. § 1001.952(h), with respect to any discounts customer may receive or have received in connection with this program. (For example, if purchaser is required to report its costs on a cost report, then (i) the discount must be based on purchases of the same good bought within a fiscal year; (ii) purchaser must claim the benefit in the fiscal year in which the discount is earned or in the following year; (iii) purchaser must fully and accurately report the discount in the applicable cost report; and (iv) purchaser must provide, upon request from Medicare or Medicaid, this invoice or purchasing document that shows the applicable discount.) The Applied Biosystems® 3500 Dx and 3500xL Dx Genetic Analyzers CS2 with the 3500 Dx Series Data Collection Software 2011 (v1) are in vitro diagnostic devices intended for the sequencing (detection and identification) of fluorescently labeled deoxyribonucleic acid (DNA) by capillary electrophoresis. The Applied Biosystems® 3500 Dx and 3500xL Dx Genetic Analyzers CS2 with the 3500 Dx Series Data Collection Software 2011 (v1) are indicated for use with FDA-cleared or approved sequencing assays specifying their use, and only by technologists trained in laboratory techniques, procedures, and use of the analyzer.

Trade in a capillary electrophoresis instrument for a discount off the list price of a new 3500 Dx Genetic Analyzers CS2 instrument. The amount of the discount will vary depending on the type of instrument the customer trades in, but may be up to $40,000. Discount will apply to the list price in effect at the time the order is received by Life Technologies. Life Technologies must receive your purchase order no later than December 31, 2013. Life Technologies may withdraw this promotion prior to December 31, 2013, at its sole discretion. Trade-in and purchased instruments must be submitted on a one-to-one, trade-to-purchase basis to be considered eligible for the program. Customer must request a trade-in at the time the order for the new instrument is placed. This promotion is available only for purchases of new eligible instruments. Trade-in instruments must be returned to Life Technologies within 30 days following installation of the new instrument. Life Technologies will be responsible for shipping costs on the traded-in instrument. Where necessary, customer agrees to allow a Life Technologies field service representative to deinstall the instrument from their facilities. Prior to return, customer will fully clean the customer’s trade-in unit and decontaminate it of radioactive, biological, toxic, and other dangerous or hazardous materials or substances and, if requested by Life Technologies, customer agrees to complete and return a Certificate of Decontamination to Life Technologies. Cannot be combined with other discounts or promotions. Offer void where prohibited by federal, state, provincial, or local laws or regulation or agency/institutional policy.
